Responsibilities

This attorney is responsible for providing day to day labor and employment support to the senior management team and Human Resource Department in North American Operations, including oversight of employment litigation and outside counsel spend. Position is anticipated to be closely aligned with Human Resource business partners in executing on those responsibilities.

  • Must be able to manage and address a broad range of employment matters in the North America geography. Oversee employment litigation as assigned.

  • Partner closely with HR business partners to help drive the development of employment related policy making and communication, e.g. post-termination competition.

  • Provide ongoing support to corporate and field HR staff on employment law issues, including the VP, Labor Relations, in regards to union organization and collective bargaining matters.

  • Respond to administrative agency complaints, e.g., EEOC, MCAD, OFCCP.

  • Provide legal and strategic support for employment-related compliance matters.

  • Provide guidance to the learning team on risk related training initiatives.

Qualifications

Educational Requirements:

  • JD from an accredited school. Admission to practice in at least one jurisdiction.

  • 10 years of relevant practice experience. Preferably a combination of law firm and in-house experience.

Knowledge and Skill Requirements:

  • Strong communication, interpersonal, and leadership skills.

  • Collaborative, solution-focused, self-directed and self-confident personality.

  • Demonstrated knowledge of state and federal employment discrimination and other employment-related statutes required.

  • Experience handling full range of employment issues, including employee discipline, termination, severance, workplace investigations, policy development, employment agreements, FLSA, FMLA, wage and hour issues, workplace accommodations, applications, training. Knowledge of wage and hour law strongly preferred.

  • Experience with traditional labor law (NLRA).

  • Knowledge of Canadian federal and provincial employment law preferred.
